Exactlyare you usng a rom that put it in the system folder?
That's the only reason it would be unsuccessful.
If it is then you will just have to go into the system/app folder delete or backup the gallery.apk app and then you can install the new one. Then you can rename it to gallery and move it into the system folder if you want to be able to back it up to system.

didn't work.
i deleted the gallery3D.apk from the system/apps
and then i moved the new one to that folder and tried to install, no luck.
moved it to the root of sd card, no luck installing.
ideas?
now the gallery is gone.
originally i just renamed the gallery3d.apk to gallery3d.apk.bak but that didn't work either.

I had the same probably. I had to go Settings>app>manage>menu button filter to see all>uninstall cooliris labeled app. then it will work.

Actually any app in the market would be a 3rd party app.
Seeing as the code is open source, couldn't someone just offer the app within the market place anyways for free?
