Was this illegal of Motorola?

Hey guys,

I sent in my phone to Motorola because I broke the screen but everything else was fine on it.
It took them a really long time to get back to me about it and i had to make several calls but I got the replacement phone this monday and there was a letter stating that they sent me a replacement device instead because it was taking too long to fix my phone?
When I turned on the phone, it had a bunch of stuff already on it like apps, texts, phone numbers, pictures, etc.
It was a bunch of personal stuff from the last person who had the phone! The phone itself resets every 3 minutes.
Is the fact that Motorola sent me a defective phone with somebody's personal information in it illegal?

Welcome to the droid forums...
Call moto and let them know the situation.. if you didn't factory reset your device before you sent it, then your info is at risk as well. .

I'd be getting on the phone..

Lol... smart phones... mobile porn access for most people. Lol. do a factory data reset on the phone and it will be gone...it might also clear up the issue you're having.

They should be factory restarting the phones before sending them out as replacements. Is it illegal? Probably not.

They tell you to do a factory reset before sending in your device...

Perhaps moto felt you were.... um... needing something to take your mind off the phone? Roflol

I bought a phone off Ebay with a cracked screen and the guy had left 3 videos of him and his wife......ya know, as well as nude pictures of the wife. I'm guessing she's be pretty p.o.'d if she knew she was floating around the phone repair circuit for all Android nerds to enjoy

Chances are if they didn't do a fdr then they sent you a phone they never repaired... because that is one of the first things they would do to repair it. I would definitely call Motorola.
