Swap Hardware Right after upgrade...?

We have to lines (both unlimited data (iPhone/Nexus). The iPhone line has an upgrade which she doesn't want. If I upgrade the iPhone line to the Note2...go home and swap the Note 2 to my line and put her iPhone back in place...is that allowed..?

Essentially, I'm taking the upgrade from line 1 and putting it on line 2. I know the line 1 iphone will be moved to GB data, but thats ok. I just heard scuttle that it needs to exist on a line for 6 months....



Also, later...when my line is eligle...can I simply call and say "give my upgrade to line1"...? I guess gift it. I just cannot lose data on my line...

I used to do this all the time on Verizon. However, if you're swapping one non-SIM phone for one with a SIM card I'm not sure how that works.
