silent mode turns off

I always have my Motorola Droid set to Silent mode with the phone vibrate option checked. I'm not sure if I am accidentally hitting a button or what I am doing but my phone rings at times when I don't want it to ring. When I go to the sound and display settings, the silent mode button is always unchecked??? Any help with this matter would be greatly appreciated.

This happens to me at work every now and then. I use Setting Profiles Lite to put it on silent & vibrate when I'm at work, I think every now and then it just kinda freaks out
