Pull down menu going craaaazy

So I pull my notification bar down and I have battery data usage ans what ever other apps I have running showing. I have unlimited data bit the data usage warning shows and all the apps in the pull down keep changing places making it almost impossible to select one. What do I do to a: get the data usage warning off and b: stop the apps from changing position like crazy?

settings>data usage>slide the orange line up on the graph.

i have no idea what's wrong with your notification bar though. something similar happened on my OG droid, but that was due to the touch screen finally crapping out after 2 years.
