HELP!!!! Screen Non responsive! It's brand new!

Sometimes, I cannot get the screen to respond to anything I do except for the hard buttons at the bottom. The phone isn't even activated yet and I have only installed a few apps. The phone is brand new and has never been rooted. It drives me crazy that the screen wont respond and I have to use the on/off button on the top of the phone to get it to do anything. Once I do that, it usually works.

What are my options to make this stop happening?

PS- I didn't get the phone from the store otherwise I would just go back... I got it off of craigslist.

SBF it and see if that fixes it or send it in for warranty if your sure it isnt rooted right now. I would sbf it to 2.3.4 and try that. Might fix it. If it doesn't sounds hardware related

Yeah, I'd sbf it and factory reset.
