It's gettin' kinda hectic in here... We have known for several years that Microsoft makes more money from its Android licensing agreements than it actually does from its own Windows Phone. As if that weren't ironic and complicated enough, things just kicked up a notch. Normally, when Microsoft signs an Android licensing agreement with an OEM, it is remarkably lop-sided in Microsoft's favor. The manufacturer who wishes to make an Android product pays Microsoft a royalty fee for the licensed patents, in exchange Microsoft agrees not to grind them into the dirt in court. In today's case, things are quite a bit more balanced as Microsoft and Dell have worked out a different arrangement.

According to the new cross-licensing deal, Dell can make Android and Chromebook devices, but in addition to paying Microsoft a smaller royalty fee, Dell will also license some of its patents for Microsoft to use in Xbox consoles. No specifics were given on what these patents will be used for exactly, but it's still intriguing to see things go a bit differently for a change. Perhaps it's both Dell's size and the past close relationship with Microsoft which facilitated such an agreement. Of course, it could simply be because Microsoft wanted the patents for the Xbox and in lieu of those would have handled things the same way they have in the past.

We'll let you know if more details emerge regarding this strangely symbiotic relationship.

Wow. I had no idea that Microsoft had anything to do with Android. I thought Google owned it outright.

You must not have seen some of our posts from last year and the year before. Microsoft owns a few patents related to Android. Rather than suing Google directly, Microsoft went after all the OEMs who were using Android and made them sign licensing agreements.

It's not that Google doesn't own Android, it's just that some of its code uses patents that Microsoft bought up in the past just to pressure Android. We wrote a number of stories on the subject that you probably missed from before you joined. ;)

Ah. That or it may be because my eyes have a tendency to sometimes glaze over or go out of focus when the cross the word microsoft. : )

Doing some reading recently...as this story bought up some points some ppl made about just what are the patents..and Moto is on of the few that stood up to MS about the patents. It seems like there are 9 patents in question...and all but 1-2 were deemed in violation. Whats wild is one of the patents involve a radio interface layer.....sue Motorola over something like that was insane IMO. Of course thats one of the ones that were not in violation. Another one that got tossed was about storage...FAT file system. It seems the most important one(s) involve calender use and Outlook type stuff.

For some reason...either Samsung vs Apple just gets more attention...but many dont know what the MS patents are. Its wild because I remember reading articles about MS vs Motorola...and totally missed it too. Its like its purposely swept under the rug by the media.

Anyway....this is how it should be done Samsung & Apple. (Moto and MS both wound up being liable for patents used by the other....for MS it was something with the 360...I dont know if the cases are over either. MS also sued and won for the amount they had to pay for the patents it was in violation of..lol. Has to be FRAND patents.)
