Will a replacement MAXX come with Jelly Bean?

So I have a few "issues" with my MAXX and I'm planning on sending it in for replacement, are the replacement phones coming with JB already installed? I don't want to lose my FoxFi/PDA Net

Got mine last week, and it came with ICS. Upgraded it to JB without any problems.

I got mine today, it came with the "Official" JB, not the XMAS leak. Other than the wonky power button, it works just fine. However, I called Verizon again, requesting a replacement for my replacement due to the power button. It seemed like it wasn't sticking out as much as my original MAXX, making it harder to press. To me, it seemed like an accident waiting to happen. They give you 90 days, and knowing my luck, it'll malfunction 10 minutes into the 91st day.
