Proposed digital download tax for Maryland

The state of Maryland is proposing a digital download tax...everything from smartphone apps to music downloads and digital books would be subject to M's 6% sales tax:

Fail. So how does it work if you're just passing through at the airport or whatever? Do they charge the tax if you're using towers or servers in the area? Seems like a bad way to go, but we shall see what happens.
