I had an app to download all the music i want, well i exchanged for a new phone and booted up, looked for the app and its gone. Did google take it off the market? If so will it be back?

Yeah, I believe Google pulled the app from the Market.

Try a google search for the name of the app, it's probably gone from the market but you may be able to find it elsewhere..

Gtunes is still on the market I believe. It's pretty good

...and that didn't raise any red flags to you? You don't get something for nothing -- especially when RIAA's involved.

Did google take it off the market? If so will it be back?

Yes. Don't expect it to return if it was pulled for infringement. Be careful which apps you discuss here (see the rules).
