Apple's Request for Injunction to Restrict Amazon's Use of "Appstore" is Denied

There has been so much drama regarding the Apple vs. Samsung lawsuit, it was easy to forget that Apple also sued Amazon for the use of the word "Appstore" in their title, Amazon Appstore. It looks like the first round of legal fighting turned out in Amazon's favor, for now. Although it was of little surprise that the judge ruled this way, Apple's request for injunction to stop the use of the word "Appstore" was denied. The standard of proof for enforcing this type of injunction is set necessarily high. The trademark infringement must be so obvious that there would generally be no argument about consumers' likely confusion. The judge in this case felt that Apple did not meet this burden of proof. The next part of the legal battle will be going to trial, and the date for that is set for October 2012.

Apple had already tried suing the City of New York to stop it from calling itself the Big Apple and using a logo in the form of an apple.
 
Someone needs to kick apple out of its high seat here, give'em a taste of reality. Or at least whoever is getting all these bright ideas to sue the crap out of people

Texas just passed a law that if the plaintiff looses a case, they are forced to pay for all legal and lawyer fees of the defendant. I am expecting to see other states follow suit, as this will eliminate many frivolous law suits by making sue happy people think twice.

Patent and trademark lawsuits are typically put through federal court. Would a state law on tort reform have jurisdiction in a federal court case?
 
That type of tort reform would never get passed in NY. The most powerful politicians in the state capital, including the governor, are all lawyers. Heck, they've blocked ethics reform that would have forced those lawyer/politicians to disclose their client lists so they can be recused if legislation comes up for a vote and one of their clients is an interested party in the legislation.

Wow....and I mean that in the most shocked way I can think of...I can see why some ppl just dont like em.

That logo NYC wanted to use doesnt look anything like Apple's logo...at all.

I think this is hilarious especially since "Apple" are the original ripoff artists! Look up how many times they were sued by the REAL Apple, the BEATLES APPLE label before they finally came to a working agreement!

Wow...just...wow, I'm speechless. How does ANYONE back apple? I just don't get it. And I didn't think it was possible to hate apple any more...
