Market says I have terminal emu installed

I cannot install terminal emulator because the market says I already have it. I did have it before 2.2 OTA but I flashed back and started fresh. Any ideas? I did look on the sd card and it is not there.

Found it in system/apps but cannot install it. Would it be safe to delete term.apk from there and redownload?

The fact that it is in system/app is what is stopping the download, delete it from system/app, reboot your phone and then the Market Version should install fine
