Yeah it says "FAILED" instantly its says I have the option but just won't let me

A lot of people have had this issue. Download LTE On Off, force 1x (set to CDMA only, not CDMA auto), and try again. It takes a couple hours to download over 1x but it works.

same with me... keep getting that error message since friday "download failed"

With my Thunderbolt, once the download started I went back to the LTE on/off and turned it back on. It finished downloading at 4g.
