Patent Wars Stories Part 2: Samsung Denied Appeal to Lift Ban of Galaxy Tab 10.1

Here is the second story for today in this Summer series of patent wars. Obviously the big news over the weekend was that Apple succeeded in banning sales of the Samsung Galaxy Nexus in the United States. One of the pieces of news from earlier in the week got glossed over because of this. Just a few days prior to this, Apple also succeeded in banning sales of the Samsung Galaxy Tab 10.1 in the United States. This news wasn't as heavily looked at because it was easier to dismiss since Samsung is already selling their Galaxy Tab 2 10.1. It almost seems like a non-issue. Still, it's important to note because it sets legal precedents that give Apple further ammunition for future lawsuits. (Quick unnecessary but funny simile: It's kind of like Apple is turning their enemy's dead soldiers into zombies and using them against them.)

Of course, Samsung appealed this decision and requested the ban be lifted. The news today is that this failed. The judge basically ruled that the import ban on the Galaxy Tab 10.1 will stand. Here's a quote from Samsung regarding the ruling,

“Samsung is disappointed with the court’s decision that denied our motion to stay. We believe today’s ruling will ultimately reduce the availability of superior technological features to consumers in the United States."

The only light at the end of the tunnel for the Galaxy Tab 10.1 is that Samsung can now appeal this decision outside of this court and take it directly to the federal level in Washington D.C. Perhaps they may find a more even-handed and reasonable judge there. The only bad news is that the buck stops there. If the appeal fails at the federal level, that's it, the Samsung Galaxy Tab 10.1 is toast in the United States.

I think that Apple invented the rectangle. So any phone in that shape needs to be taken off the market.

It has something to do with the new google voice search. It works like Siri, so Apple said no-no.

If it talks back to you like a person, I guess that they would be copying it, but if it is just an updated evolution of the voice command and voice search that has been a part of Android for about 3 years now, Apple needs to STFU and build a better phone.
