Temp goes well beyond 40 degrees and at the same time radio signal suffers. Anyone else having this problem or do I have a defective phone?

Well, I'm getting a replacement anyway. Perhaps newly manufactured ones will fare better.

how hot can the battery get before it starts being bad for it/doing damage? I've been using it as a hotspot and it gets up towards 45 degrees

I have found out that its just not heavy 3G usage Wifi plays a huge part. try using blue tooth to tether, My phone never gets over 35 C with bluetooth but with wifi its up to 46C which is way to hot for a phone.

My phone at full load after streaming a 2 hour movie may get to 41 or 42 at most, which is still hot for the battery. Taking off ur batt cover may help with this, or use setcpu or anything to underclock the phone when it gets hot
