It's 100% legal as defined by a court ruling earlier this year.
If they sent them out rooted then how could we brick them while rooting them? They don't want them rooted because a) it allows access to tethering apps and they want to milk every penny they can out of us like any capitalistic entity, and b) it's a terrible security risk.

Is there really a significant difference in speed from 600mhz to 800 mhz?
Yes. 30% faster top-end speed so your phone feels snappier and smoother. Pushing it to 1GHz really helps with both of those, though, if you're lucky enough to have a phone that can handle it.

So will not all phones handle overclocking? Is going to 800 or 1000mhz a big burden on the phone?
It can be. You'll be able to tell if your phone is stable at higher speeds pretty quickly though.
No, not all droids can handle 1ghz. Mine could, but now I have a continuum. : P
