Court Rejects Apple's Request for a Sales Ban on the Samsung Galaxy Nexus... Again

    I suppose you can't fault them for trying (actually, yes you can), but Apple's second request to have the Samsung Galaxy Nexus banned in the US was denied by the courts again. Originally, Apple requested a ban on the Samsung Galaxy Nexus, and it was granted briefly last year. Samsung appealed and was able to get the ban lifted relatively quickly. Apple then appealed this decision and tried to get the device banned again. Today's ruling effectively shuts that down. Here's a quote with some additional detail,

    Things are continuing to look very bright for Samsung and very bleak for Apple. It's both funny and sad to see Apple still trying so hard to ban a phone that will basically become a non-issue this year.

    They want it banned for precedent. That way it will be easier to get other phones banned in the future. Apple just cant stand that someone is taking a "Bite" out of them. LOL

    Where does the technology aspect come in to play? Maybe my brain isn't working on all gears just yet, but I don;t recall the patents involved to be anything more then design patents. Nothing technologically marveling about a rectangle with rounded edges.

    Sad? Nah let them eat into that massive cash surplus Job's spoke of that iSheep like to praise Apple for.

    It's like Judge Koh's recent rulings as well. Apple requested triple damages and she shot them down since they couldn't prove that Samsung willfully violated the patents. And while Samsung's request to have the jury decision thrown out and to have a retrial was also shot down, that was more because of a procedural issue rather than the judge making a decision. It was reported that Samsung needs to submit that request to the appeals court and not to the original judge to render a decision.
