There are free apps in the market like Foxfi, open garden, and pda net, etc. IMO, if they are there, use them. I think the issue is when you hack verizon app and use it for free. This was done on the DX with a flashable zip that modified the nv ram and in turn you could use the native tether app at no charge. Just like you can use Google Maps for free or pay $3/month for vzw navigation (do they still charge for this?), or Google Voice's visual voicemail for free or pay for vzw vv. The minute you "hack" vzw's paid app and use it for free, you are breaking your TOS. Vzw has every right to charge a fee for their proprietary apps, that doesn't mean you cannot use a free alternative that is available in the market.
