Return after Jan 9th/14-day period?

what if they don't fix this issue until maybe a month after Jan 9th and i decide this is getting rediculous and return it? Can i just explain that this isnt a phone if i cant make calls, and just get my money back or exchange? I don't this phone for work, more for play, but i DID buy a phone; I expect to be able to place calls without going to my window.
