You're probably forgetting that there are laws against slander and libel of a person's character, lawsuits are bad.

You're also forgetting Verizon could simply blacklist his phone and it won't work anymore.

99% sure that slander and libel only apply when it isn't true. Nothing that he suggested was false, therefore no grounds for a lawsuit.

Also pretty sure that blacklisting the phone would lead to a lot more trouble than it is worth for a mistake that VZW didn't even make. I don't think they would bring that upon themselves.

I'm sure a lot of you have already seen the ZDNet article explaining the Google Wallet issue. This issue never delayed this phone. It HAD to be missing from this phone due to a Google deal with Sprint - not anything Verizon could do. That was basically a good article and worth a read (not sure if I can post a link to it here).

I think that the Sprint Google Wallet exclusivity only applied to the Nexus S.

I find this comical. A few things to keep in mind;

1) The hourly employees at BB could probably care less. If they get fired they can get an hourly job somewhere else. No big deal.
2) The managers there are probably in a world of pain. This is their career and a bad evaluation will stick with you. I would imagine many people received written reprimands on this issue.

What I would do if I were him: I'd tell the manager that I 'negotiated' with at BB that I'll include their name in any forthcoming video and blog as the person who was responsible for selling it to me. I would tell them that our contract on that receipt did NOT entitle them to call for the item's return so if they would like it back we would have to agree on a new contract (and price). If they don't offer me what I want, I follow through with my promise and start posting Youtube videos of the phone with the manager's name and BB contact info. The heat will hit them through their corporate office. Worst case scenario I just got a Nexus early! Yay! If the screen has issues then he can swap it out within 2 weeks and surely it'll be released by then. Best case scenario they offer something to me as a valued customer. I return the phone and take down the videos. Wait a week then buy the phone again (or BB gives it to me for free).

Sounds like this guy is not a shrewd negotiator, or maybe he's just not as greedy as me.

This is what went wrong in my mind.
1 Bad communication on all parts. Verizon most likely just sent a mass email, but they could have forced a reply and made a automatic checklist for each retail store. Apparently not too many stores got this so its probably this best buys communication problems.
2. bad managing and the person who sold the phone messed up as well. He manually put it 999999 really!?!? I worked in retail as a cashier this summer and a few things confilct with this. The cashier had to be trained and working there for a while. You dont start off working in phones and knowing where they are placed in the back rooms. He had to know the sim cards... everything. He was aware of what he was doing. from my experience, when an item was not working in a system or was a high price, a manager would come over and confirm it. The manager probably put the 99999s in.
3. (ill keep it shorter now) BB went through it all wrong. They should not have given complete bs to the customer. they should have said the truth and that jobs were at stake.

I feel bad for the manager on duty and the cashier. One small mistake

I have always leaned toward Jack, the regular for mixing and Gentleman's if I want it straight. Although I will always try something different. Maker's Mark is always a good choice

Ok, not to change topic, and I''m sorry if this is in the wrong section, just wanted to ask:

I know that the Gnex has an unlocked bootloader and will easily be rooted.
I also have seen some other posts about other phones and a question of whether S-Off is on or not.

What is S-Off and does it come into play with the GNex?

If Verizon is dealing with legal issues, you don't think they would blacklist the phone? That's a bit naive. It's the first thing they would do to cover their ass.
