Can't send photo text to "some" contacts.

I have a strange issue. Whenever I attempt to send a photo text message, sometimes it works and sometimes it doesn't. If it doesn't work once with a specific contact, then it never works. If it does, then it always does. I have no idea why it doesn't work. The really weird part is that I can send an ordinart text message to all my contacts.

Ok, experts, what's up with that?

a text is sms, text with a picture is mms, both are sent with stock messaging app
my messaging app data is total 696KB, app 688KB, data 8.00KB, cache 0.00
could clear data,or try different app from market
wipe cache in android recovery, wipe data if nothing else works

titanium shows
[sms/mms/apn] dialer storage 2.3.5
[sms/mms prefs] messaging 2.3.4

I would wipe data for both

I use "sms backup +" to save sms, mms, and call logs, it can restore sms and call logs, not mms, last time i tried
but the mms are view able in gmail where they are saved
