Will a rooted off-contract DROID A855 be capable of tethering without a data plan?

I was wondering if I could just pop in a SIM card from a prepaid Samsung without getting a data plan. Also, it was going to be an AT&T card, so could that get me in trouble, or do they only care if people do it with iPhones?

THe original droid does not have a slot for sim cards. The milestone may have a slot for sim card but vzw droids do not.

IIRC it wouldn't work on AT&T anyway....I know the D2 does not.
